Sinclair assistant - Refusing to spawn?

I've had my assistant refuse to spawn 4 or more times, procing my cooldown but simply not having it appear? Possibly during taking damage only, but I'm not certain.

the terrain or something is fuccd, if it's by any margin a not so flat terrain you are putting it, it doesn't work
