When in spectator mode post-death, you're typically still able to hold tab/alt in order to level up your abilities. However, if spectating a Patron (maybe other NPCs as well?), such as when your team has been wiped, you can't level up during death. This can be an issue in the aforementioned situation since you want to rush out if spawn without worrying about leveling abilities.
