Omnicharge Signet Charge Count bug when charges are enabled later with AP

While playing as Venator in street brawl I purchased omnicharge signet and imbued it on my 1.
the 1 now had 3 charges as it should

AFTER purchasing omnicharge signet I upgraded the 1 to the max level "allowing charges"
however the number of charges remained 3 when upgrading with AP when it should be 5


Doing the same steps but the other way around (maxing ap then imbuing with the item) gives 5 charges
