The way I imagine the flak rounds to work, is to ease up hitting targets that are far away. The rounds themselves don't deal additional damage, and the radius is small enough to be inconsequential to opponents standing close to each other. (Unless they are touching each other of course).

This item is primarily meant to counter flying enemies. I think it's best to place it as a tier 4 item, as with proper balancing it would tear through enemies without cover, even at long distances. Compared to a lot of other tier 4 weapon items, it has slightly weaker stats to prevent it from becoming a core pick. It is only meant to be situational against enemies that like to keep their distance. But who knows, it could also become a weapon for said enemies, as its main asset is providing weapon fall-off.
 
This sounds nice for dealing with flyers but Slowing Hex already ruin their day. I can see this being nightmarish on Paradox or Haze in a game they're dominating.
