In my testing it seems to be about a 50/50 chance for an initial spirit damage hit to show either the -15% spirit resist debuff or the amped damage debuff. In the clip below you can see that the bot doesn't have a stack counter but Infernus does which maxes at 20 as it should with EE. However, the first cloak on the bot does 210 and the second does ~510 which would make sense with having both the 120% damage amp plus the -15% spirit resist debuffs applied.
