Cheat Death doesn't stop Talon Bird from killing you

This happened before the most recent update, but I just recreated it in the sandbox in the attached video. I was playing Dynamo and had ulted in the midboss pit with Unstoppable active and Cheat Death was definitely off cooldown (i remember specifically checking before the fight and communicating it to my team). Talon birded me mid-ult and I died instantly without cheat death activating.

Seems like a problem with execute mechanics not respecting Cheat Death triggers. Does this happen without the 3rd upgrade which includes and execute?

YES and thats especcially the prob why you want this item

It used to be the case that cheat death would prevent you from getting executed but it's not longer the case. I assume this is intended.
